While there may be an extra sensitivity to such matters given our location in a Marital Property state, we are often asked to assist clients with respect to the establishment of Marital Property Agreements. Many times, these agreements are utilized in connection with an estate plan generally. However, there are also many occasions where engaged persons or recently married individuals seek to identify, negotiate and memorialize the rights and obligations they may have vis-a-vis their future or current spouse regarding the property either or both may own. There are many reasons why individuals and couples seek to implement these agreements, and therefore the process may vary significantly one client to the next. However, protecting family assets, including perhaps a family business or vacation property, is a common motivation.
